General Terms and Conditions
1:Scope
These General Terms and Conditions of Sale apply to every agreement between the company AVD according to Belgian law, established in 2070 Zwijndrecht, Beversebaan 43, Belgium, VAT: BE 0671.606.224, e-mail info@avdvelgen.be (no visiting address) and the consumer. These conditions are valid for Belgium. The agreement comes into effect as soon as we have confirmed your order. If you do not invoke your cancellation right, you are obliged to pay under this agreement. The sales agreement is only implemented when we accept your order by delivering the goods or informing you of the delivery. By clicking on the 'order with payment obligation' button, the items are ordered from your shopping basket. You will immediately receive confirmation of this order via an automated e-mail. With this confirmation via e-mail the purchase agreement is a fact.
2: Prices
1. All prices on the AVD website include 21% VAT.
2. For the products, the prices are applied as stated on the AVD website or quotations made subject to typing or printing errors. AVD has the right to inform the buyer before delivery if this is the case.
3. The AVD products are supplied at the prices that apply on the date of order.
4. Transactions between companies outside Belgium, with a valid VAT number, and AVD can take place under intra-Community regulation.
3: Offers
1. The price quotes from AVD are not an offer.
2. Offers are only issued on special request and have a validity of 7 days unless otherwise indicated.
3. Quotations are without obligation, unless stated otherwise in the quotation.
4: Cancellation and return
1. The buyer is entitled to cancel or return an agreement if the buyer has notified AVD in writing within 7 days and the products have been returned within 14 days. AVD must immediately confirm the written cancellation so that the agreement can be declared void. The return costs will be borne by the customer when the information about the reason for the return for the purchase of the product was known. Return costs for returning 4 individual rims can be estimated at 60 euros including VAT, return costs for a set of rims with tires can be estimated at 80 euros including VAT.
2. Specially ordered or produced goods and / or goods for the buyer can never be canceled by the buyer. These goods and / or items are not taken back and may not be refused by the customer.
3. Ordered rims that serve as "sparepart" or replacement of your current set, which is not supplied by AVD, fall under specially ordered products due to the risk of color and shape difference.
Return conditions and instructions for tires AVD
You have the right to return tires purchased from AVD within a period of 14 days after receipt. If there is no culpable reason to return the tires, we will charge you a return fee for this. The return costs depend on the delivery method, the type of item and the country of delivery. Cost of band in Belgium 10€ piece, abroad 15 € piece VAT incl.
Tires that are under the (mounting) fat or on which are written are not suitable for resale and will therefore not be credited. Therefore we would like to expressly request that you return the tires in their original condition and undamaged, otherwise we cannot credit the tires.
Download the return form on our website if you want to return a tire. After completing the form, send it to our email or to the business address as part of the check. Of course you can also return the tires yourself. When submitting a return request, you can indicate the desired return method.
After completing and printing, the return form must be attached to the tires that you want to return. We recommend fixing the document with plastic (laminating) before attaching it to the tire (s). When returning more tires, a return form must be attached to each tire. In this way we can determine who has returned the tires. Without the return form we cannot determine the origin of the tires and therefore we cannot send you a correction. Therefore, ensure that the return form is correctly attached to your tires.
5: Payment
1. Seller allows the following payment methods:
-( a ) via electronic payments: pay safely via Mollie (Bancontact, KBC / CBC, IDEAL, ING, BELFIUS, MASTERCARD, VISA)
-( b ) a traditional transfer to the Seller's bank account maintained by ING Bank on the account number: BE44 3771 3248 3445
2. The customer is obliged to make the payment within 2 calendar days from the date of receipt of the message confirming the acceptance of the order by the Seller, specifying the total cost of the order together with delivery (conclusion of the contract).
3. If the buyer has not paid the invoice on the due date, the buyer will be in default and without interest to AVD of 1.5% over the outstanding amount per month, whereby a month entered will be charged for a whole .
4. AVD is entitled to hand over the matter for collection if payment is not made. As soon as AVD has done this, all judicial and extrajudicial costs will be borne in full by the debtor.
5. Complaints and / or warranty claims taken into consideration do not give the right to a deferment of payment or partial payment.
6: Warranty
1. AVD is responsible for the high quality of the services it provides and for the soundness and good quality of the products supplied, on the understanding that the guarantee does not go beyond the provisions stated below.
2. 12-month material and paint guarantee is provided on delivered rim products, unless stated otherwise.
3. You have the right to have tires examined, purchased from AVD, if you believe that these are technically not in order. Claims can be submitted up to 12 months after the invoice date. If a claim is granted, we will not charge any costs for the investigation and will credit the band (s) concerned. If, after an investigation, it appears that you have incorrectly registered a tire as a claim with us, we will charge you 25, - euro research costs per tire. If you have the tires collected by us, we will also charge you the logistics costs, this of course only applies if the claim is rejected. If the claim is granted, we will take care of all logistics costs and credit the tires to you. If we credit the tires, they will not be returned to you. If the claim has been rejected and you want to receive the tires back, shipping costs will be charged again. Claims for tires with a tread worn down for more than 10% will not be processed. Keep this in mind if you want to register the tires as a claim. The buyer must provide the products that are eligible for replacement or repair with a clear description of the complaint depending on the brand and type.
4. If you are offered the shipment with apparent damage to packaging, contents or otherwise, report this immediately upon delivery to the courier and to AVD within 24 hours. Always ask for a note of this damage to the courier. Do not assemble the wheel set until you have been in contact with AVD about any subsequent steps. After it has been determined whether it concerns transport or assembly damage, the damaged products will be replaced in consultation with the customer. Already mounted rims and tires on your vehicle can never be claimed for damage upon receipt. It is therefore advisable to inspect the rims immediately upon receipt.
5. If the defects are caused by the buyer, all repairs and shipping costs are for his account.
6. The buyer cannot invoke the warranty provisions:
a. If the buyer has neglected the products.
b. If the buyer has made changes to the products or has had them made, including repairs that have not been carried out by or on behalf of AVD.
c. In the event of improper or careless use, incorrect assembly, damage due to the ingress of moisture or other external causes or calamities.
d. In the event of damage due to the effects of brine and salts.
e. If the product has not been maintained in the usual manner or described in the instructions for use.
f. If the product is used with minor or incorrect accessories.
g. If the buyer has neglected the products in the following or other way: use of snow chains - resale of the rims - damage due to incorrect cleaning agents - damage due to high-pressure cleaners - insufficient maintenance - usual wear (including curb damage) - damage from outside or by third parties - crushed stone - corrosion - impact damage of hammered lead during balancing by third parties - use of incorrect valves by third parties - consequential damage caused by tire installation by third parties.
Claim conditions and instructions AVD
You have the right to have the tyre inspected, bought at AVD, if you think the tyre contains a technical fault. Claim tyres can be returned up to 12 months after invoice date. When a claim has been approved we will not charge you for the research on the tyre and a credit note will be provided. When after research we have come to the conclusion that the tyre does not contain any technical faults, we have to charge you €25,- inspection costs per tyre. If you have asked us to pick-up the tyre we will charge you the logistical costs as well, this is only applicable when the claim is not approved. When the claim has been approved we will take care of all transport costs. When we approve the claim, the tyre will not be returned. If the claim is not approved and you would like to have the tyre back, additional transport costs have to be paid for sending the tyre back again.
Claims regarding a tyre that is worn more than 10% will not be processed and the claim will be declined in advance. Please keep this in mind before starting a claim procedure. We also see examples of clients returning a complete set as a claim, where actually only 1 of the tyres is a “claim tyre”. We would like to emphasize that you only send back the claim tyre, to prevent unnecessary inspection costs for the other tyres.
To submit a claim you are required to fill in the claim form in our webshop. The form can be filled in at the menu “Download Claim form”.
Please attach the claim form to the tyre. We advise you to protect the form with plastic (plasticized), before attaching it to the tyre. When you are returning multiple tyres, you are obliged to attach a form to each tyre. This way we are able to determine who returned the tyres. If the return form is missing it’s very likely we can’t locate the origin of the tyre(s) and therefore we will not inspect the tyre(s) and a credit note can’t be provided. Please ensure the form is properly attached to the tyres.
7: Delivery
1. When paying on invoice, by receiving the purchase price on our account or by cash on delivery, delivery will take place by sending your order within 2 tot 10 working days(tyre), 4 tot 10 working days (rims). If the delivery time exceeds 10 working days, the buyer will be notified with a statement of the reason for the delay.
2. The specified delivery periods are not strict deadlines and should be interpreted as an effort obligation and are deemed to have been approximated.
3. Exceeding a delivery period never gives the buyer the right to any compensation, dissolution of the agreement or any other action against AVD.
8: Shipping
1. The products are sent at the risk of AVD unless the buyer has arranged transport himself. The buyer bears the risk for the products from the moment they are offered for delivery to the specified address.
2. The buyer is obliged to take delivery of the products upon delivery. Failing this, the products are stored by courier service. The associated costs are for the account of the buyer as to be reported.
3. If the buyer refuses to take delivery of the products upon delivery, they will be sent back to AVD, possibly after storage at courier service.
4. In the event that the buyer has refused to accept an ordered COD shipment without legal cancellation or has not collected it for 2 weeks from the storage location to be specified by courier service, AVD will send the buyer an invoice for costs incurred. This includes, among other things, the transport costs, administration costs and possible depreciation. These costs amount to 15% of the principal with a minimum of € 60. In the absence of payment, AVD is entitled to hand over the matter for collection.
9: Offers
1. All offers mentioned on the AVD website apply as long as they are on the site.
2. AVD reserves the right to implement price changes in the offers.
10: Force majeure
1. If AVD cannot fulfill its obligations to the buyer due to force majeure, the fulfillment of those obligations will be suspended for the duration of the force majeure situation.
2. If the force majeure lasts 30 days, both parties have the right to terminate the agreement in writing in whole or in part, insofar as the force majeure situation justifies this.
3. In the event of force majeure, the buyer is not entitled to any (damage) compensation, even if AVD should have any advantage as a result of the force majeure.
4. AVD will inform the buyer as soon as possible of an (imminent) force majeure.
11: Limitation of liability
1. AVD does not accept any responsibility for damage to other products from the buyer or third parties which is directly or indirectly caused by a defect in a delivered product.
2. AVD is in no way liable for damage to products that has arisen due to incorrect treatment, incompetence, incorrect assembly, incorrect use or use outside the specifications.
3. Furthermore, AVD does not accept any liability for any damage whatsoever, caused by irresponsible or unsafe use during use, in whatever form and while driving or standing still.
4. AVD is an internationally promoting company. AVD therefore has to deal with various tire and / or rim sizes in accordance with various separate guidelines. No rights can be derived from the tire sizes and rim sizes shown in the AVD configurator. AVD is in no way responsible for the accuracy of tire sizes and rim sizes for each vehicle shown on the AVD website. The customer is always responsible for the accuracy of his or her purchased rim and tire specifications. Before purchasing, the customer must check whether the purchased products correspond or fall within the tolerances described on the certificate of conformity or the vehicle papers for which the products are intended. You can consult your certificate of conformity, vehicle papers, garage or dealer for this. AVD is not liable for a possible rejection at your annual car periodic inspection.
12: Trademark
1. The factory or trademarks or the type or identification numbers or signs that are affixed to the products delivered by AVD may not be removed, damaged or altered. Any change, anyway, will void the warranty.
13: Retention of title
1. The ownership of products supplied by AVD is expressly reserved until the full purchase price has been paid.
14: Dissolution
1. If the buyer fails to meet his obligations towards AVD, fails to do so in time or does not comply properly, and if his bankruptcy is / is being filed for, he is declared bankrupt, he applies for a moratorium, or his creditors or part offers them a settlement or arrangement, furthermore in the event of seizure of all or part of his assets, or if he proceeds to the sale or liquidation of his company, as well as in the event of death, placing under guardianship or if he otherwise manages or loses management of his company, products or a part thereof, the buyer is legally in default and any claim that AVD has against him or acquires, is immediately and suddenly due and payable without any notice of default being required.
2. In cases mentioned under (1), AVD has the right, without any notice of default, on its part to suspend further performance of the agreement or to dissolve it wholly or partially or to make use of the provisions of article 13.
3. AVD is entitled at all times to claim compensation from the buyer, as well as to take back the products delivered.
4. In the event that the buyer wishes to terminate the agreement, he will always first default to AVD in writing and grant it a reasonable period of time to still fulfill its obligations, or to rectify shortcomings, which shortcomings the buyer must accurately provide in writing. to describe.
5. The buyer has no right to dissolve the agreement in whole or in part or to suspend his obligations if he himself was already in default with the fulfillment of his obligations.
6. In the event of partial dissolution, the buyer cannot claim the cancellation of services already performed by AVD, and AVD is fully entitled to payment for the services it has already performed.
7. With regard to the Distance Buying Law, private buyers are allowed to use a legally regulated cooling-off period of 14 days to be able to return unused and in perfect condition that can be purchased, and the full purchase amount will then be reimbursed by AVD.
